It's up in the air. Sources are saying that RVD was not happy with his last WWE run and may not re-sign due to it. One source overheard someone talking about WWE being better than TNA, and Van Dam gave an odd reaction. Saying it was "sort of the same". While he may not go back to TNA, he may not go back to a major company at all. Of course he could always re-sign with WWE, but for now, he's done with the company.
